Terms and Conditions of the Online-Shop

1. General Remarks for Terms and Condition

These terms and conditions apply to all purchase and usage of all services as well as all deliveries from SandozMedica Ltd ordered via the online-shop. By placing an order, the customer agrees with these terms and conditions. These terms and conditions cover all deliveries of products and services purchased in the online shop www.sandozmedica.com of SandozMedica Ltd. (henceforth referred to as « sandozmedica.com »). Orders can be placed exclusively by consumers resident in Switzerland and with shipping addresses in Switzerland on the internet page www.sandozmedica.com. Goods will be issued in standard household quantities only. Customers who wish to place orders for commercial or freelance professional requirements should contact the provider by e-mail (info@sandozmedica.com).

2. Offering / Prices

All offers from sandozmedica.com are without engagement and non-binding. Subject to change prices or the range of products as well as mistakes are without prior notice. Pictures or products can differ in colour and design form the original. From the time when an order is placed, prices are binding. To see the current prices, visit www.sandozmedica.com. All prices are in Swiss Francs and include 7,7% VAT (value added tax). In case of a mistake of the pricing, sandozmedica.com reserves the right to change prices after the order was placed. In such a case, sandozmedica.com will inform the customer as soon as possible and the customer can step back from the purchase of the particular product.

3. Orders/Delivery

The contract will come off as soon as the customer accepts the order at the end of the ordering process after choosing his or her payment method, which is either by credit card, by PayPal or prepayment. Placing an order is binding and will be confirmed with an E-mail to the given e-mail address of the customer. sandozmedica.com reserves the right to decline any orders from any customer. The customer is responsible for the completeness and correctness of the entered invoice and delivery address. If there is incorrect information, sandozmedica.com reserves the right to decline an order. Products which are not available from stock have to be ordered from the manufacturer. If so, a contract will only come off as long as sandozmedica.com is being delivered with the particular product. If a product is no longer manufactured or cannot be delivered a contract will not come off. An annulment of the ordered products is only possible with an agreement from sandozmedica.com. By placing an order, the purchaser confirms that he is at least 18 years of age.

4. Delivery

sandozmedica.com owns a large stock of all products which are acquirable on the online shop. Products in stock will be normally packaged and mailed on the current or the following day of the order. Therefore, a customer will receive his order within 1 to 4 workdays. Products which are not available from stock have to be ordered from the manufacturer. Consequently the delivery can be delayed. In no case, delays in delivery justify a claim for indemnity or a right of withdrawal. Delivery time and dates are non-binding. Right after receiving the package the customer must check it for completeness. False deliveries have to be reported to sandozmedia.com within 5 days. Otherwise, sandozmedica.com reserves the right to charge additionally delivered products. If sandozmedica.com delivers for account of the customer with a payment slip, the delivered products will be property of sandozmedica.com until the owed amount of money is paid.

5. Delivery quantity/Reservation of title

sandozmedica.com reserves the right to limit the delivery quantity for specific products or to not delivery a specific product. If there is an unpaid invoice of a customer or a person who lives in the same address, sandozmedica.com reserves the right to decline orders or hold them back until the unpaid invoice is paid. Goods remain the property of sandozmedica.com until full payment has been made.

6. Shipping Costs

sandozmedica.com sends all deliveries with the Swiss Post. There is a CHF 6.- shipping fee for prioritary packages (A). If the customer does not accept the delivery and wants to step back from the contract, the customer still has to pay CHF 10.- for delivery and activities costs. If a delivery comes back and has to be sent to the customer again, an additional delivery cost of CHF 6.- will be charged.

If the entire order is returned, and the client requests the termination of the contract of sale, the customer is held to settle the shipping costs and additional administrative work costs in the amount of CHF 10.- .

7. Returns

If a customer wants to return the delivered products, an application mentioning the reason of return has to be carried out within 5 days after receipt. Returned deliveries or products without the acceptance of sandozmedica.com can be declined. In case of an acceptance, sandozmedica.com will inform the customer in written form or with an e-mail. Returned products will only be accepted unused and in their original packing with the dated purchase receipt.

sandozmedica.com checks the return after the goods receipt and decides whether it is in perfect condition to be refunded. The refund will be made on the same payment method as the original payment and usually within 14 working days. The buyer shall pay any incurred shipping costs concerning the return of the product.

8. Complaints

Complaints regarding the quality of delivery or products will only be accepted within 14 days after receipt.

9. Our warranty for the produts

9.1 For products which do not have a manufacturer’s guarantee, we provide a warranty that on delivery and for a period of 8 weeks from delivery, the products shall be free from material defects. However, this warranty does not apply in the circumstances described in clause 9.2.

9.2    The warranty in clause 9.1 does not apply to any defect in the products arising from:

  1. fair wear and tear;
  2. willful damage, abnormal storage or working conditions, accident, negligence by you or by any third party;
  3. if you fail to operate or use the products in accordance with the user instructions provided with the product or on our website;
  4. any alteration or repair by you or by a third party who is not one of our authorized repairers; or

any specification provided by you.

10. Invoicing / dunning process

For our business customers the invoices will be sent to the given address with the delivery of the ordered products. Invoices must be fully paid within 30 days without any reduction or any other discount. Unauthorized reductions will be charged subsequently. If the invoice has not been paid in due time, a first payment reminder will be sent for free. The second and last payment reminder will be sent with an additional service charge of CHF 10. If the invoice is not paid within 15 days, enforcement will be applied immediately.

11. Damage during transport

Any possible transport damage has to be reported to the Swiss Post immediately. sandozmedica.com reserves the right to decline any transport damages which are not proven by a damage report. Transport damages have to be reported within 5 days.

12. Payment

The invoice amount including shipping costs can be paid per credit card (PayPal). sandozmedica.com uses ensured systems to transfer data, especially credit card numbers are ciphered via SSL technology.
If the customer has no credit card, he has the ability to perform the payment through advanced bank transfer via the following bank connection:

12.1. The goods will be sent after receipt of payment.

13. Privacy Policy

sandozmedica.com assures to treat all personal customer data confidential and not to pass them on to third parties. In the context of ordinary business data can passed on to business partners. Customers can change their personal data under ‘my account’. E-Mail addresses can be used for contact, order confirmation or newsletter purposes.

14. Liability

sandozmedica.com cannot be held liable for damages or subsequent damage caused by the products sold by sandozmedica.com. In particular, damages based on usage of the product, error of performance or loss of production as well as not being able to deliver, breach of contract or errors in contract fulfilments are not valid against sandozmedica.com.

15. Law / Court

The contract is solely governed by Swiss Law. Court of jurisdiction is Yverdon-les-Bains, Switzerland.

16. Changes in Terms and Conditions

If sections or individual terms of this terms and conditions are not legal or correct, the content or validity of the other parts remain uninfluenced by this fact. sandozmedica.com reserves the right to change these terms and conditions anytime and apply them immediately.

17. Referrals and links

sandozmedica.com may contain third party content or links to third party websites. These content and links are provided solely for customer friendliness and information. sandozmedica.com is not liable for any third party content or websites, especially the correctness, completeness, quality or timeliness of these websites. sandozmedica.com is not liable for third party content or websites or websites linking to or framing sandozmedica.com.

The copyright for any pictures, videos or texts created by sandozmedica.com is reserved. Any duplication or use of objects such as pictures, videos or texts in other electronic or printed publications is not permitted without the agreement of sandozmedica.com.
